Terms of Service

1. Parties and Agreement

These Terms constitute a legally binding agreement between you ("User", "you") and Lernspark Ltd, trading as PollyX ("we", "us", "our"), the operator of the PollyX sentiment intelligence platform accessible at pollyx.org (the "Service").

If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" refers to that entity.

2. Description of the Service

PollyX is an AI-powered sentiment intelligence platform. It allows users to generate detailed reports on the online sentiment, reputation and public perception of brands, companies, products or topics (each a "Subject"). Reports are generated using artificial intelligence and publicly available data sources including, but not limited to, news articles (via the GDELT Project), YouTube video data (via the YouTube Data API), and live web search results (via the Claude models by Anthropic).

Reports are informational in nature and do not constitute legal, financial, investment or professional advice of any kind.

3. Eligibility

To use PollyX you must:

• Be at least 18 years of age, or the age of legal majority in your jurisdiction
• Provide accurate and complete registration information
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable law

4. Account Registration and Security

You must register for an account to access the Service. You agree to:

• Provide true, accurate and current information during registration
• Keep your password secure and not share it with any third party
• Notify us immediately at contact@pollyx.org of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that show evidence of compromise, abuse or violation of these Terms.

5. Pricing, Payment and Credits

5.1 Pricing Model

PollyX operates on a pay-as-you-go basis. There are no subscriptions, recurring charges or monthly fees. Each report is purchased individually at the price displayed on the pricing page at the time of purchase. All prices are in Euros (EUR) and include applicable VAT where required by EU law.

5.2 Payment

Payments are processed by Stripe through Stripe Managed Payments, under which Stripe's Link service acts as our merchant of record: your statement shows the purchase as sold through Link, and Link handles receipts, tax and payment support. By making a payment you also agree to Stripe's terms for these purchases. We do not store your full card details. Payment is collected before report generation begins - you will be redirected to a secure Stripe checkout page when you request a report.

5.3 Report Payment

Each payment covers one report generation. The payment is processed once and does not renew. There is no minimum purchase and no commitment beyond the individual report purchased.

5.4 VAT and Taxes

Prices displayed include VAT applicable to EU consumers. Business customers in EU member states who provide a valid VAT number may have VAT reverse-charged in accordance with EU Directive 2006/112/EC. Customers outside the EU are responsible for any local taxes or import duties.

6. Refund Policy

PollyX reports are digital products generated on demand and delivered immediately. Accordingly, all sales are final once a report has been delivered. At checkout you expressly request immediate performance and acknowledge that you lose your 14-day right of withdrawal under Article 16(m) of Directive 2011/83/EU once report generation begins.

• Failed reports are refunded automatically - a technical failure first grants one free re-run; if the report still does not generate, you are refunded and not charged. A report that cannot gather enough public data is refunded immediately and in full to the original payment, with no replacement credit
• Credit packs, where offered, are non-refundable once purchased
• Genuine billing errors (e.g. duplicate charges) are refunded in full - email us within 14 days

7. Acceptable Use

You may use PollyX only for lawful purposes and in accordance with these Terms. You agree not to:

• Generate reports about private individuals who are not public figures, in a manner that could constitute unlawful surveillance, harassment or stalking
• Use reports to defame, harass, threaten or harm any individual or organisation
• Attempt to manipulate, reverse-engineer or circumvent our systems, AI models or rate limits
• Scrape, copy or redistribute report content for commercial resale without our written permission
• Submit false, misleading or fraudulent input data
• Use the Service in any way that violates applicable EU or national laws, including those relating to data protection, defamation, and unfair competition
• Use automated bots or scripts to generate reports without prior written consent

We reserve the right to suspend or terminate your account without notice for material violation of this section.

8. Intellectual Property

8.1 PollyX Platform

All software, design, trademarks, logos and content comprising the PollyX platform (excluding report outputs and third-party data) are the exclusive property of PollyX and protected by applicable intellectual property laws. No licence is granted to copy, reproduce or modify platform elements.

8.2 Report Outputs

Reports generated by the Service are licensed to you for your own personal or internal business use. You may share, print and present reports internally. You may not resell reports or present them as your own original research product without attribution to PollyX.

8.3 Third-Party Data

Reports may contain summaries of or references to publicly available content from third parties (news articles, YouTube videos, social media posts). Such content remains the property of its respective owners. PollyX does not claim ownership over third-party source material.

8.4 Restricted-Platform Content and Data Protection

Some platforms' terms restrict how their content may be reproduced. Reports therefore aggregate rather than reproduce content from such platforms: Instagram and TikTok material appears as links, engagement counts and derived analysis only, and verbatim post text from Instagram, TikTok and X is not included in API or MCP payloads (links to the original posts are provided instead). PollyX's analysis - scores, themes, summaries and insights - is PollyX's own work product; the underlying platform content remains subject to the originating platform's terms, and you are responsible for your own compliance when accessing it through the links provided.

You may not extract, compile or republish third-party personal data contained in reports. Requests from individuals concerning personal data appearing in report sources can be sent to contact@pollyx.org and are handled as described in our Privacy Policy.

9. AI-Generated Content - Accuracy Disclaimer

PollyX reports are generated using artificial intelligence models (Claude, by Anthropic) and automated data retrieval. While we strive for accuracy, AI-generated analysis may contain errors, omissions, outdated information or hallucinations. Reports reflect publicly available sentiment signals at the time of generation and are not a complete or guaranteed picture of public opinion.

You are solely responsible for verifying report contents before making business decisions based on them. PollyX is an information tool, not a substitute for professional advice.

10. Service Availability

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may perform scheduled maintenance, apply patches, or experience downtime due to factors outside our control (including third-party API availability). We will endeavour to give advance notice of planned maintenance where feasible.

Report generation depends on third-party APIs (Anthropic, Tavily, YouTube, GDELT). Temporary unavailability of these APIs may delay or affect report quality. In such cases we will offer a credit replacement at our discretion.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• PollyX is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement
• We shall not be liable for any indirect, incidental, consequential, punitive or special damages arising from your use of the Service
• Our total aggregate liability to you in connection with the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim

Note for EU consumers: Nothing in this section limits or excludes statutory rights you have as a consumer under EU law, including those under Directive 2019/770 on the supply of digital content and services. Mandatory consumer protection provisions of the law of your EU member state of habitual residence shall apply where they provide greater protection.

12. Indemnification

You agree to indemnify and hold harmless PollyX and its officers, directors and employees from any claims, damages, losses, liabilities and costs (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any third-party rights; or (c) any content or data you submit to the Service.

13. Termination

By you: You may close your account at any time from your account settings. Upon closure, your personal data will be deleted in accordance with our Privacy Policy. As PollyX is pay-as-you-go, there are no unused credits or recurring fees to settle on closure.

By us: We may suspend or terminate your account immediately, with or without notice, if you materially breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

Sections 8 (Intellectual Property), 9 (AI Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law) and 15 (Dispute Resolution) survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, Spanish law. For EU consumers, mandatory consumer protection provisions of your country of habitual residence apply alongside these Terms and take precedence where they provide greater protection.

15. Dispute Resolution

We encourage you to contact us first at contact@pollyx.org to resolve any dispute informally. We will attempt to resolve your complaint within 15 business days.

If we cannot resolve your complaint informally, EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

For business users, any disputes that cannot be settled amicably shall be subject to the exclusive jurisdiction of the competent courts.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may close your account.

17. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PollyX regarding the Service and supersede all prior agreements and understandings relating to it.
