These Terms constitute a legally binding agreement between you ("User", "you") and Lernspark Ltd, trading as PollyX ("we", "us", "our"), the operator of the PollyX sentiment intelligence platform accessible at pollyx.org (the "Service").
If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" refers to that entity.
PollyX is an AI-powered intelligence service with two products. A Brand Sentiment Report analyses the online sentiment, reputation and public perception of a brand, company, product, person, topic or campaign (each a "Subject") from publicly available sources such as news (including through the GDELT Project), YouTube (through the YouTube Data API), social platforms, forums, review sites and live web search. An AI Visibility check asks third-party AI assistants the questions a buyer might ask about a Subject or its market, and records how they answer, which brands they name and which pages they cite. Both are produced with artificial intelligence, on our systems and those of the suppliers listed in our Privacy Policy.
PollyX, these Terms and every report and check are provided in English. Reports and checks are delivered in your dashboard, which works in any current web browser, and can be exported in common formats (PDF, PowerPoint, spreadsheet and Markdown files). No special software is needed, and exports carry no copy protection.
Reports are informational in nature and do not constitute legal, financial, investment or professional advice of any kind.

We reserve the right to suspend or terminate accounts that show evidence of compromise, abuse or violation of these Terms.
PollyX is sold pay as you go: you buy a single report or AI Visibility check, both together as the Full Picture, a copy of a published report from the catalog, or a pack of credits, at the price shown at the time of purchase. One credit buys one report or one AI Visibility check, and credits do not expire. We may also offer optional monthly plans (section 5.4) and optional add-ons to an AI Visibility check (section 5.6); no plan or add-on is required to use the Service. All prices are in Euros (EUR).
Payments are processed by Stripe through Stripe Managed Payments, under which Stripe's Link service acts as our merchant of record: your statement shows the purchase as sold through Link, and Link (Sold through Link, LLC, a Stripe affiliate) handles receipts, tax and payment support. By making a payment you also agree to the Link Terms of Service, and Link handles your payment details under the Link Privacy Policy. Link's own refund policy also applies to these purchases, alongside ours (section 6). We do not store your full card details. Payment is collected before a report or check starts: if your account holds no credit for it, you are taken to a secure Stripe checkout page.
A single report, a single AI Visibility check or a credit pack is charged once and does not renew. There is no minimum purchase and no commitment beyond what you buy.
Where we offer a monthly plan, it is a subscription that renews automatically every month, at the price shown when you subscribed, until you cancel. Each month it includes the allowance described on the pricing page at the time of purchase, which pays for any AI Visibility check or Brand Sentiment Report, whether you run it yourself, through the API, or on a schedule before any credit is used; an allowance not used within its month does not carry over, while credits never expire. You can cancel at any time, with no notice period, with Cancel plan on your dashboard, in your Link account at link.com, or by asking us. Cancelling stops the next renewal, and the month you have already paid for stays active until its end date. If we change the price of a plan, we will email you at least 30 days before the new price applies to your next renewal, and you can cancel free of charge before then; a month you have already paid for is never repriced. Your statutory rights as a consumer are not affected.
Prices include VAT: the price shown is the total you pay. Link, as merchant of record, collects and pays that tax. Where the checkout lets a business customer enter a VAT number, the tax is applied accordingly. Where no tax is collected at checkout, you are responsible for any local taxes that apply to you.
Extra questions and cities added to one AI Visibility check are charged once, by card, together with that check. Daily tracking, and extra questions or cities added to every check of a tracked brand, are monthly subscriptions that renew automatically every month, at the price shown before you paid, until you stop them. You can stop one at any time on the brand's Daily tracking page or by asking us: stopping it stops the next renewal, and the month you have already paid for runs to its end. Section 5.4's 30 days' notice of a price change applies to them too.
Reports and AI Visibility checks are digital content generated on demand when you order them. When you order, you tick a box to ask us to begin straight away and to confirm that, once generation has begun, you lose your 14-day right of withdrawal for that item (Article 16(m) of Directive 2011/83/EU, as implemented in Ireland). Accordingly, all sales are final once a report or check has been delivered, except as follows:

You may use PollyX only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to suspend or terminate your account without notice for material violation of this section.
All software, design, trademarks, logos and content comprising the PollyX platform (excluding report outputs and third-party data) are the exclusive property of PollyX and protected by applicable intellectual property laws. No licence is granted to copy, reproduce or modify platform elements.
Reports and checks generated for you are licensed to you for your own business or personal use. You may share, print and present them, including to your clients, and you may replace our branding with your own on exported PDFs through the white-label settings. You may not resell them as a standalone product except through the PollyX catalog (section 8.5).
Reports may contain summaries of or references to publicly available content from third parties (news articles, YouTube videos, social media posts, reviews, and answers given by third-party AI assistants). Such content remains the property of its respective owners. PollyX does not claim ownership over third-party source material.
Some platforms' terms restrict how their content may be reproduced. Reports therefore aggregate rather than reproduce content from such platforms: Instagram and TikTok material appears as links, engagement counts and derived analysis only, review sites are summarised rather than quoted, and verbatim post text from Instagram, TikTok, X and other social platforms is not included in public share pages or in API or MCP payloads (links to the original posts are provided instead). PollyX's analysis - scores, themes, summaries and insights - is PollyX's own work product; the underlying platform content remains subject to the originating platform's terms, and you are responsible for your own compliance when accessing it through the links provided.
You may not extract, compile or republish third-party personal data contained in reports. Requests from individuals concerning personal data appearing in report sources can be sent to contact@pollyx.org and are handled as described in our Privacy Policy.
Listing is optional and off by default. If you list a report in the PollyX catalog, you grant us a non-exclusive licence, for as long as it stays listed, to show a preview of it and to sell copies of it, exactly as generated, to other customers. For each copy sold you earn half a report credit, as described on the catalog page. You can unlist a report at any time; copies already sold remain with their buyers. White-label accounts cannot list reports.
PollyX reports are generated using artificial intelligence models from third-party providers and automated data retrieval, and AI Visibility checks record answers given by third-party AI assistants exactly as given; we do not vouch for the accuracy of those answers. While we strive for accuracy, AI-generated analysis may contain errors, omissions, outdated information or hallucinations. Reports reflect publicly available sentiment signals at the time of generation and are not a complete or guaranteed picture of public opinion.
You are solely responsible for verifying report contents before making business decisions based on them. PollyX is an information tool, not a substitute for professional advice.
We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may perform scheduled maintenance, apply patches, or experience downtime due to factors outside our control (including third-party API availability). We will endeavour to give advance notice of planned maintenance where feasible.
Reports and checks depend on third-party data sources and AI providers. Their temporary unavailability may delay a report or check or affect its quality; a report or check that fails is handled as described in section 6 and the Refund Policy.
If an AI assistant or a data source that what you bought relies on is withdrawn for good and we cannot replace it, so that a report or check is no longer what we described when you paid, you can ask us for a pro-rata refund of your unused credits and of the unused part of a plan's paid month, even after the 14-day withdrawal period, to your original payment method.

Note for EU consumers: Nothing in this section limits or excludes statutory rights you have as a consumer under EU law, including those under Directive 2019/770 on the supply of digital content and services. Mandatory consumer protection provisions of the law of your EU member state of habitual residence shall apply where they provide greater protection.
You agree to indemnify and hold harmless PollyX and its officers, directors and employees from any claims, damages, losses, liabilities and costs (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any third-party rights; or (c) any content or data you submit to the Service.
By you: You may close your account at any time from your account settings. Upon closure, your personal data will be deleted in accordance with our Privacy Policy. Closing your account cancels any monthly plan at the same moment, so it is never charged again, and any unused credits end with the account. If you bought a pack or a plan within the last 14 days, ask us to refund the unused part (section 6) before you close the account.
By us: We may suspend or terminate your account immediately, with or without notice, if you materially breach these Terms, engage in fraudulent activity, or if we are required to do so by law.
If we close your account for any other reason, or stop providing the Service, we refund the credits you have not used and the unused part of a plan's paid month, pro rata, to your original payment method, and we give you notice by email first wherever we can.
Sections 8 (Intellectual Property), 9 (AI Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law) and 15 (Dispute Resolution) survive termination.
These Terms are governed by the laws of Ireland, where Lernspark Ltd is registered. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, which apply alongside these Terms and take precedence where they give you more protection, and you may bring proceedings in the courts of that country or of Ireland.
We encourage you to contact us first at contact@pollyx.org to resolve any dispute informally. We reply within 48 hours and aim to resolve a complaint within 15 business days.
If we cannot resolve your complaint informally, EU consumers can ask the European Consumer Centre in their country for help (in Ireland, ECC Ireland), and can contact their national consumer authority (in Ireland, the Competition and Consumer Protection Commission).
For business users, any dispute that cannot be settled amicably is subject to the exclusive jurisdiction of the courts of Ireland.
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may close your account.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and PollyX regarding the Service and supersede all prior agreements and understandings relating to it.
